1. Acceptance of These Terms
These Terms of Service ("Terms") govern your access to and use of lunafreshshop.com (the "Site") and your purchase of products from Luna Fresh ("Luna Fresh," "we," "us," or "our"). By browsing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

3. Who Can Order
You must be at least 18 years old, or the age of majority in your province, and able to form a legally binding contract to place an order on the Site.
4. Our Products
Luna Fresh products are handmade, small-batch cosmetics intended for external, personal use only. They are not intended to diagnose, treat, cure, or prevent any disease, and are not a substitute for professional medical advice. If you have a skin condition, allergy, or are pregnant or nursing, please consult a healthcare professional before use, and always patch-test a new product before full use.
Because our products are handmade in small batches, minor natural variations in colour, scent, or texture between batches are normal and are not considered defects.
Full ingredient lists are published on each product page. It is your responsibility to review the ingredients for known allergies before purchasing or using a product.
Luna Fresh cosmetics are notified to Health Canada under the Cosmetic Notification requirement, as required for cosmetics sold in Canada. Our first product was notified in January 2023.
5. Our "Ask Luna" AI Assistant
The AI-powered chat assistant on our Site is provided to help you learn about our products and ingredients. It is a shopping tool, not a medical professional, and its responses should never be treated as medical, dermatological, or professional advice. Always confirm ingredient or safety information against the product label, or consult a healthcare professional.
6. Orders, Pricing & Payment
All prices on the Site are listed in Canadian dollars (CAD) and do not include applicable taxes or shipping, which are calculated at checkout. We reserve the right to correct pricing or listing errors, and to cancel and refund any order affected by such an error, even after an order has been confirmed.
Payment is processed securely through Stripe. Your order is only confirmed once payment has been successfully authorized. We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, or unavailable inventory, in which case we will issue a full refund.
7. Shipping
We currently ship to addresses across Canada. Estimated delivery times are provided at checkout and are not guaranteed; delays caused by shipping carriers are outside our control. Risk of loss and title for products pass to you upon delivery to the shipping carrier.
8. Cancellations, Returns & Refunds
Because our products are handmade cosmetics that touch the skin, we are only able to accept returns of unopened, unused products in their original packaging, within 14 days of delivery. Please contact [email protected] before returning a product. If a product arrives damaged, defective, or incorrect, contact us within 7 days of delivery with a photo, and we will replace it or issue a refund at no cost to you.
Nothing in this section limits any right you have under Alberta's Consumer Protection Act to cancel a contract that does not meet the disclosure requirements for internet sales contracts, or any other right that cannot be waived under Alberta law.
9. Intellectual Property
All content on the Site — including text, product photography, graphics, logos, and the Luna Fresh name and branding — is owned by or licensed to Luna Fresh and is protected by Canadian and international copyright and trademark law. You may not reproduce, distribute, or use our content for commercial purposes without our prior written consent.
10. Acceptable Use
You agree not to use the Site to: violate any applicable law; attempt to gain unauthorized access to our systems; interfere with the Site's security or functionality; or submit false, fraudulent, or abusive orders or communications.
11. Disclaimer of Warranties
The Site and its content are provided "as is," without warranties of any kind, to the fullest extent permitted by Alberta law. We do not warrant that the Site will be uninterrupted or error-free.
12. Limitation of Liability
To the fullest extent permitted by law, Luna Fresh's total liability arising out of or related to your use of the Site or purchase of our products will not exceed the amount you paid for the product(s) giving rise to the claim. Nothing in these Terms limits liability for gross negligence, wilful misconduct, or any liability that cannot be excluded under Alberta consumer protection law.
13. Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts of Alberta for any dispute arising from these Terms, except where Alberta consumer protection law grants you rights that cannot be limited in this way.
14. Changes to These Terms
We may update these Terms from time to time. Changes take effect once posted on this page with a new effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.
